How to Register and Transfer a Land Title in Uganda : After coming up with an idea of owning a piece of land in Uganda, it is very crucial that this piece of land is genuinely registered and transferred into your name as the current owner. The process may seem hectic on the outer observation but actually it can be simplified in a few steps explained below by Moorland Consults.

PICK A SEARCH AND CONSENT FORM FROM ANY LAND OFFICE.

This is the first step in registering land in Uganda. This form can be picked from the ministry of lands and it can be accessed from any ministry of lands offices across the country. It is where you fill out the initials about the land to be searched. Land registry also provides a Bank Advice form, which is used to pay cash in the bank for the search. It is this form where the official government taxes are paid. Also in cases of freehold ownership, one does not have to request consent to transfer. This very form will be used to determine the amount of tax payments owned and to make payments.

PAYMENT OF SEARCH FEE

Payments are the next step in the process and it is done from a designated Bank upon which a receipt is granted. This is a receipt that must be presented at the registry before the search is conducted.

PROCEED WITH THE SEARCH AND DRAFT THE AGREEMENT

This search is only and only conducted at the registry. The receipt of payment obtained from the bank for the search has to be presented before the search can be conducted. It is also at this point that you pick up the consent to transfer the application. After all this is done, an agreement is drafted and it is normally done by a lawyer however it is not mandatory though it is a common practice as a matter of confidence.

PROPERTY VALUATION

Property valuation is normally done by the Chief Government Valour and it is mainly done to determine the value of the property for the transfer purposes, assessment and also for stamp duty payment.

GET CLEARANCE FORM AND ASSESSMENT OF STAMP DUTY

Immediately the value of the property is approved, the file is taken to the URA desk where an assessment form for stamp duty is provided. However, for anyone purchasing land that is valued at 50M and beyond, an income tax clearance indicating the source of income must be provided for tax purposes. Furthermore, for any Uganda transferring a land title a Tax Identification Number(TIN) must be also provided.

PAYMENT OF STAMP DUTY

The stamp duty must only be paid to the designated Commercial Bank. The bank immediately notifies URA after the payment. There is a mandatory reconciliation process that takes place between the bank and Uganda Revenue Authority and it takes three working days.

CONSENT TO TRANSFER BY THE LAND BOARD IN KAMPALA

These transfer forms are taken to the Land Board in Kampala for consent where the receipts of payments must be presented. However, if companies are involved in the transaction, they must file with the company’s registry for a special authorization and it costs a fee of Sh.20,000.

ASSESSMENT OF REGISTRATION FEES

Thereafter, the sales agreement is then presented to https://www.kcca.go.ug/ to approve the registration fee. An assessment form with a registration fee to be paid is provided thereafter at a designated bank. These documents include a signed sales agreement, a receipt of payment of the stamp duty, and a company’s resolution to buy and sell.

TRANSFER DOCUMENTS ARE THEN KEPT AT THE REGISTRY OF LANDS

These transfer documents are later kept at the Registry of lands and then transmitted to the Registrar and he/she is the only one with the mandate of passing any transfer. And then it is sent to the commissioner in charge of land registration for verification.
